We, the organisations signing below denounce to the nacional and internacional community the new harassment, persecution and attempt to silence and intimidate defenders of the fundamental rights of the most vulnerable sectors in the social and armed conflict in Colombia, and particularly in the country?s south west.

THE FACTS

1.- The National Attorney General (Fiscal?a General de la Naci?n) has a summary document in which appear the names of 13 social leaders, trade unionists, political opposition leaders and human rights defenders from the Cauca Valley, falsely charged with the crimes of rebellion and terrorism.

2.- The Third Brigade of the National Army and members of investigative units fabricated a confused and dangerous judicial document with which they attempt to carry out a massive detention against those branded as members of a Narco-Terrorist Organisation at the service of the FARC and the ELN.

3.- The cited Judicial Frame-up charges the following of being members of national and international terrorist groups:

Senator of the Republic, ALEXANDER LOPEZ MAYA;

President of the Association for Research and Social Action, BERENICE CELEYTA ALAYON;

President of Sintraunicol [University Workers Union], CARLOS ARBEY GONZ?LEZ;

Coordinator of the Foundation Committee for Solidarity with Political Prisoners (Valle de Cauca Section), MARTHA NIDIA ASCUNTAR ACHICANOY;

Secretary of Education of Sintrametal [Metalworkers Union], WILLIAN ARLEY ESCOBAR HOLGUIN;

Vice-president of the CUT [trade union federation] ? Valle del Cauca, OTONIEL RAM?REZ LOPEZ;

former president of SINDESENA [Further Education Workers Union] and candidate for Congress, WILSON NEBER ARIAS CASTILLO;

Coordinator of the Human Rights Departament of the CUT - Valle del Cauca, ARIEL D?AZ;

member of the co-ordinating team of the Foundation Committee for Solidarity with Political Prisoners (Valle de Cauca Section), FERNANDO S?NCHEZ ESCOBAR;

former President of SINTRAEMCALI, LUIS ANTONIO HERNANDEZ MONRROY;

former treasurer of SINTRAEMCALI, HAROL VIAFARA GONZALEZ;

Secretary of the Peace and Coexistence Office of the Governor of Valle del Cauca, FRANGEY REND?N GALVEZ;

Director of Tel? Pacifico and adviser to the Governor of Valle del Cauca, HECTOR ALONSO MORENO PARRA;

besides several workers of the Municipal Corporation of Cali EMCALI EICE ESP, the majority of whom are victims of the mass sackings made by the employer.

4.- The document is filed with code FGN CTI SIA 358 and 359, referenced as "Item, work project, number 334 and 335" lead by doctor LUIS RAM?REZ RIOS, Director of the Cali-Valle branch of the Technical Investigation Corps (CTI), National Attorney General and which is addressed to doctor MARIA EUGENIA LORA CASTA?O, Attorney 132 Section, highlighted as the Third Brigade of the National Attorney General. The document includes an organigram entitled "ORGANIGRAM OF ALEXANDER LOPEZ MAYA?S SERVICE" and defines five structures in the following manner: TRADE UNIONJ, ARMED, JUDICIAL, POLITICAL AND MBNC. According to them the members are distributed as follows: TRADE UNION: Carlos Gonz?lez, Otoniel Ram?rez, Wilson Arias and Ariel D?az, ARMED: Indumiles, JUDICIAL: Martha Ascuntar, Berenice Celeyta and Fernando S?nchez; POLITICAL: Frangey Rend?n and Alonso Moreno; MBNC: Ernesto Yepes and Alejandro Ram?rez [Translator?s note ? MBNC is acronym for Movimiento Bolivariano por la Nueva Colombia, clandestine movement of the FARC].

5.- Senator ALEXANDER LOPEZ MAYA, made a request for information from the National Attorney General (Fiscalia), Dr. MARIO IGUARAN ARANA to obtain information on this or after investigations that were to be carried out by the Fiscalia against the mentioned leaders. Strangely, in the response by the Fiscalia to the Senator this investigation was not cited, nor any other investigation for the crimes of rebellion or terrorism against any of the persons charged in the report FGN CTI SIA 358 and 359 by the CTI, Fiscalia.

6.- Apart from the serious and false allegations against each of the leaders, this report also contains their personal data: addresses; home, office and mobile phone numbers; family names; children; time of leaving home and transport routes etc.

7.- With FGN CTI SIA 358 and 359 an attempt is being made to justify a collective haul or an operation of massive detentions as has been taking place across the country under the policy of ?democratic security? by which 6,332 persons have been arbitrarily deprived of their liberty in the last three years.

8.- The information contained in this judicial frame-up is besides a death sentence against those named persons reported to be members of national terrorist organisations , putting at risk the security, lives, liberty, dignity, honour and integrity of the most recognised political, social, trade union and human rights leaders in the Valle del Cauca.

BACKGROUND

TWO YEARS ON: THE OPERATION DRAGON PLAN CONTINUES

1.- 25 August 2004, a murky extermination plan called by its authors ?Operation Dragon " was revealed and made known to the National Attorney General (Fiscal?a).

2.- That same day the Fiscalia ordered two raids, one in Cali and the other in Medell?n, succeeding in catching red-handed the operation of an illegal intelligence network involving serving and retired military personnel and two companies called CIL (Consultar?a Integral Latinoamericana) and SERACIS (a private security company) and several Colombian state institutions, in possession of classified and private information on the entire leadership de of Valle del Cauca.

3.- Amongst the information found on 25 August 2004, with Lieutenant Colonel JULIAN VILLATE LEAL was the intelligence report CIME RIME elaborated by the Third Brigade of the Army, which is headquartered in Cali. Besides a flow diagram there was a list of 170 people including the 13 leaders cited in the latest absurd Judicial Frame-up by the Fiscalia, which again appears to have been born in the intelligence department of the Third Brigade of the Army.

4.- It was the Third Brigade of the Army, currently being publicly questioned because of the existence of links between some of its officers and the drug cartels and paramilitary groups, that supplied the CIME RIME intelligence report to Lt. Col. JULIAN VILLATE LEAL.

5.- The latest report FGN CTI SIA 358 and 359 by the Fiscalia?s CTI unit, appears at the very time that the legal process against the material and intellectual authors of the Operation Dragon extermination plan is about to be closed or put on file. According to the Fiscalia, and to the Posecutors Office (Procuradur?a General de la Naci?n), there would be no merit in opening a formal investigation against military personnel, and the state and government agents compromised in these grave goings on.

WE SEEK

1. That the Colombian Government and in particular the President of the Republic ALVARO URIBE VELEZ, the Vice-president FRANCISCO SANTOS explain the reasons why they keep persecuting the leaders of the Valle del Cauca, especially the political opposition leaders, trade union leaders and defenders of human rights.

2. That the security and the physical and psychological integrity, as well as the free exercise of their professions, be guaranteed for those whose names appear in the document FGN CTI SIA 358 and 359, referenced as " Item, work project, number 334 and 335."

3. That those intellectually and materially responsible for this judicial frame-up against the above mentioned leaders be investigated and judged in exemplary manner.

4. That the Fiscalia and its CTI unit be asked to publicly clarify the origin of the information contained in the FGN CTI SIA 358 and 359 document.

5. That the relation between the extermination plan known as Operation Dragon and the judicial frame-up referenced as Report No. FGN CTI SIA 358 and 359 be investigated.

6. That CTI Investigator JAIME ALONSO MESA CADAVID, LUIS RAM?REZ RIOS, Director of the Fiscal?a CTI Cali-Valle and doctor MARIA EUGENIA LORA CASTA?O, Fiscal 132 highlighted before the Fiscal?a Third Brigade, - who appear as signatories in the name of CTI Cali Valle, to the Report No. FGN CTI SIA 358 and 359 ? be investigated.

PLANEAN DETENCION MASIVA CONTRA DESTACADOS

DIRIGENTES DEL VALLE DEL CAUCA

Las organizaciones abajo firmantes denunciamos ante la comunidad nacional e internacional el nuevo hostigamiento, persecuci?n e intento de silenciar e intimidar a defensores de los derechos fundamentales de los sectores m?s vulnerados por el conflicto social y armado en Colombia y particularmente en el sur occidente colombiano.

LOS HECHOS

1. La Fiscal?a General de la Naci?n posee un sumario en el cual aparecen los nombres de 13 l?deres sociales, sindicales, dirigentes pol?ticos de oposici?n, y defensores de derechos humanos del valle del Cauca, sindicados falsamente de delitos de rebeli?n y terrorismo.

2.- La Tercera Brigada del Ejercito Nacional y miembros de los cuerpos de investigaci?n fabricaron un confuso y peligroso expediente judicial, con el que se pretende efectuar una detenci?n masiva contra quienes se?alan como miembros de una Organizaci?n Narco Terrorista al servicio de las FARC y el ELN.

3.- El citado Montaje Judicial sindica de de ser integrantes de grupos terroristas nacionales e internacionales, al senador de la Republica ALEXANDER LOPEZ MAYA; la Presidenta de la Asociaci?n para la Investigaci?n y Acci?n Social Nomadesc BERENICE CELEYTA ALAYON; El Presidente de Sintraunicol, CARLOS ARBEY GONZ?LEZ; la Coordinadora de la Fundaci?n Comit? de Solidaridad con Presos Pol?ticos Seccional Valle del Cauca MARTHA NIDIA ASCUNTAR ACHICANOY; El secretario de educaci?n de Sintrametal, WILLIAN ARLEY ESCOBAR HOLGUIN el Vicepresidente de la CUT ? Pacifico y asesor del despacho de la Gobernaci?n del Valle del Cauca HECTOR ALONSO MORENO PARRA, adem?s de varios trabajadores de las Empresas Municipales de Cali EMCALI EICE ESP, la mayor?a de ellos v?ctimas de los despidos masivos hechos por esta empresa.

4.- El documento archivado, bajo el numero FGN CTI SIA 358 Y 359, referenciado como "Asunto, misi?n de trabajo, numero 334 y 335" dirigido por el doctor LUIS RAM?REZ RIOS, Director de la seccional del Cuerpo T?cnico de Investigaci?n Fiscal?a General de la Naci?n Cali-Valle y cuya destinataria es la doctora MARIA EUGENIA LORA CASTA?O, Fiscal 132 Seccional, destacada ante la Tercera Brigada Fiscal?a General de la Naci?n; incluye un organigrama que titula "ORGANIGRAMA AL SERVICIO DE ALEXANDER LOPEZ MAYA" y define cinco estructuras de la siguiente forma: SINDICAL, ARMADA, JURIDICA, POLITICA Y MBNC. Seg?n ellos integradas de la siguiente as?: SINDICAL: Carlos Gonz?lez, Otoniel Ram?rez, Wilson Arias y Ariel D?az, ARMADA: Indumiles, JURIDICA: Martha Ascuntar, Berenice Celeyta y Fernando S?nchez; POLITICA: Frangey Rend?n y Alonso Moreno; MBNC: Ernesto Yepes y Alejandro Ram?rez.

5.- El Senador ALEXANDER LOPEZ MAYA, efectu? una solicitud de informaci?n al Fiscal General de la Naci?n, Dr. MARIO IGUARAN ARANA con el fin de obtener informaci?n sobre esta o tras investigaciones que se estuvieran adelantando por parte de la Fiscalia contra los dirigentes mencionados. Extra?amente en la respuesta que la Fiscalia remite al Senador no aparece esta investigaci?n ni ninguna otra por delitos de rebeli?n o terrorismo contra ninguna de las personas sindicadas en el informe FGN CTI SIA 358 Y 359 del CTI de la Fiscalia.

6.- Este informe contiene adem?s de graves y falsas sindicaciones contra cada uno de los dirigentes, sus datos personales direcciones, n?meros de tel?fonos oficina, residencia y celulares, nombres de los familiares, hijos, recorridos horas de salida de la residencia y rutas de trasporte etc.

7.- Con el informe FGN CTI SIA 358 Y 359 se pretende justificar una redada colectiva o una operaci?n de detenciones masivas y arbitrarias como las que se han presentado en todo el territorio nacional en desarrollo de la pol?tica de "Seguridad democr?tica" por medio de la cual 6.332 personas han sido privadas arbitrariamente de su libertad, en los tres ?ltimos a?os.

8.- La informaci?n que contiene este montaje judicial es adem?s una pena de muerte contra quienes se encuentran all? relacionados como integrantes de las ONT, y pone en riesgo la seguridad, la vida, la libertad, la dignidad, la honra y la integridad de los m?s reconocidos dirigentes pol?ticos, sociales, sindicales y defensores de derechos humanos del Valle del Cauca.

ANTECEDENTES:

OPERACI?N DRAGON DOS A?OS DESPUES CONTINUA EL PLAN

1.- El 25 de agosto de 2004 fue develado y puesto en conocimiento de la Fiscal?a General de la Naci?n, un sombr?o plan de exterminio denominado por sus autores: "Operaci?n Drag?n".

2.- Ese mismo d?a la Fiscalia ordeno dos allanamientos, uno en la ciudad de Cali y otro en la ciudad de Medell?n, logrando encontrar en manos de una red ilegal de inteligencia a la que pertenecen Militares activos y en retiro y dos compa??as que se hacen llamar CIL (Consultar?a Integral Latinoamericana) y SERACIS (Compa??a de seguridad Privada) y varias instituciones del Estado Colombiano, en posesi?n de informaci?n clasificada y privada de toda la dirigencia del valle del cauca.

3.- Entre la informaci?n que se encontr? el 25 de agosto de 2004, al Teniente Coronel JULIAN VILLATE LEAL aparece el informe de inteligencia CIME RIME elaborado por la III Brigada del Ejercit?, con sede en la ciudad de Santiago de Cali. Adem?s de un diagrama de flujos con una lista de 170 personas entre los que se encentran los 13 dirigentes incluidos en el montaje judicial de la Fiscalia, al parecer este absurdo montaje judicial naci? tambi?n en el departamento de inteligencia de la Tercera Brigada del Ej?rcito.

4.- La Tercera Brigada del Ej?rcito, actualmente cuestionada p?blicamente por la existencia de v?nculos de algunos de sus oficiales con los carteles de la droga y bandas paramilitares, fue quien suministro a teniente coronel

JULIAN VILLATE LEAL, el informe de inteligencia CIME RIME.

5.- El informe FGN CTI SIA 358 Y 359 del CTI de la Fiscalia, aparece en momentos en que el proceso judicial contra los autores materiales e intelectuales del plan de exterminio llamado por sus autores "Operaci?n Drag?n", se encuentra en la etapa de cierre y/o archivo del proceso. Seg?n la Fiscal?a y Procuradur?a General de la Naci?n, no existir?a merito para abrir una investigaci?n formal contra los militares, agentes estatales y gubernamentales comprometidos con estos graves hechos.

SOLICITAMOS:

1. Se requiera al gobierno Colombiano y particularmente al Presidente de la Republica ALVARO URIBE VELEZ, al Vicepresidente FRANCISCO SANTOS explique las razones por las cuales se continua persiguiendo a los dirigentes del Valle del Cauca en particular a los lideres pol?ticos de Oposici?n, dirigentes sindicales y Defensores de derechos humanos.

2. Se garantice la seguridad e integridad f?sica sicol?gica y libre ejercicio profesional de quienes aparecen en el documento archivado, bajo el n?mero FGN CTI SIA 358 Y 359, referenciado como "Asunto, misi?n de trabajo, numero 334 y 335"

3. Se investigue y juzgue ejemplarmente a los responsables materiales e Intelectuales del montaje judicial efectuado contra los dirigentes mencionados.

4. Se solicite a la Fiscalia General de la Naci?n y el Cuerpo T?cnico de investigaciones CTI, p?blicamente aclare la procedencia de la informaci?n contenida el documento referenciado FGN CTI SIA 358 Y 359.

5. Se investigue la relaci?n existente entre el Plan de exterminio conocido con el nombre Operaci?n Drag?n y el montaje judicial referenciado como INFORME NRO. FGN CTI SIA 358 Y 359.

6. Se investigue a JAIME ALONSO MESA CADAVID, Investigador del CTI, LUIS RAM?REZ RIOS, Director de la seccional del Cuerpo T?cnico de Investigaci?n Fiscal?a General de la Naci?n Cali-Valle y a la doctora MARIA EUGENIA LORA CASTA?O, Fiscal 132 destacada ante la Tercera Brigada Fiscal?a General de la Naci?n, quienes aparecen firmando a nombre del CTI Cali Valle, el INFORME NRO FGNCTISIA 358 Y 359.
